PROJECTX API DASHBOARD ADD-ON REFUND POLICY

1. Introduction
This Refund Policy (as amended, restated, or supplemented from time to time, this "Refund Policy") outlines the terms and conditions under which refunds may be issued for the ProjectX API Dashboard Add-On subscription service (as updated, altered, or modified from time to time, the "API Add-On"). By subscribing to this service, you agree to this Refund Policy in addition to our Terms of Use and Privacy Policy. This Refund Policy supplements and is subject to the Terms of Use and Privacy Policy, each of which are incorporated herein by reference. Capitalized terms used herein and not otherwise defined shall have the meanings ascribed to such terms in the Terms of Use, and if not defined therein, then in the Privacy Policy.
2. Subscription Overview
Service Description: The API Add-On is a premium subscription service currently priced at $29.00 USD per month, providing authenticated access to real-time and historical trading data via REST and WebSocket APIs.
Billing Cycle: Subscriptions are billed on a monthly basis and renew automatically unless canceled by the user.
3. Refund Eligibility
Refunds are generally not provided for the API Add-On. However, refunds may be considered under the following circumstances:
Duplicate Charges: If you are charged multiple times for the same subscription period due to a billing error.
Accidental Subscription: If you accidentally subscribe and notify us within 24 hours of activation.
Service Inaccessibility: If technical issues on our end render the API completely inaccessible for an extended period, and we are unable to resolve the issue in a reasonable timeframe (being not less than 5 business days). All refund requests are subject to approval at the sole discretion of ProjectX.
4. Non-Refundable Situations
Refunds will not be issued in the following situations:
Change of Mind: If you decide not to use the service after subscribing.
Lack of Usage: If you do not utilize the API during your subscription period.
Feature Limitations: If you are dissatisfied with the service due to limitations clearly stated prior to purchase, such as the absence of TradingView charting, sandbox environments, or pre-built Trade Copiers.
5. Refund Request Process
To request a refund, please follow these steps:

Provide Information:
Include the following details in your request:
Full name and account email address;
Date and method of subscriptionDetailed explanation of the issue or reason for the refund request
Await Response: Our support team will review your request and respond within a reasonable timeframe.6. Refund Processing Timeline and MethodIf a refund is approved, the refund will be issued to the original payment method within ten (10) business days of the approval notice. Refunds will only be processed to the original payment method used at the time of purchase.7. Subscription Cancellation
User Responsibility: It is your responsibility to manage and cancel your subscription if you no longer wish to use the service.
Cancellation Timing: Cancellations take effect at the end of the current billing cycle.
No Prorated Refunds: We do not offer prorated or partial refunds for unused portions of a subscription period.8. Abuse and FraudProjectX reserves the right to deny refund requests in cases of suspected abuse, fraud, or violation of our Terms of Use. This includes, but is not limited to:
Chargeback Threats: Initiating a chargeback without first contacting support.
Repeated Refund Requests: Submitting multiple refund requests without valid justification.
Misuse of Services: Using the API in a manner that violates our acceptable use policies.
9. Consumer Protection Notice
Nothing in this Refund Policy shall be deemed to limit any rights that you may have under applicable consumer protection statutes or laws that may not be waived by contract.
10. Limitation of Liability
The API Add-On is provided "as-is" and without warranties of any kind, either express or implied. ProjectX expressly disclaims any warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall ProjectX be liable for any indirect, incidental, special, consequential or punitive damages related to or arising out of this Refund Policy, even if advised of the possibility of such damages.
11. Governing Law and Venue
This Refund Policy shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Delaware or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Delaware. You irrevocably submit to the exclusive jurisdiction of the Court of Chancery of the State of Delaware (the "Court of Chancery") or, to the extent the Court of Chancery does not have subject matter jurisdiction, the United States District Court for the District of Delaware and the appellate courts having jurisdiction of appeals in such courts (the "Delaware Federal Court") or, to the extent neither the Court of Chancery nor the Delaware Federal Court has subject matter jurisdiction, the Superior Court of the State of Delaware (collectively, the "Chosen Courts"), for the purposes of any suit, action or other proceeding arising out of this Refund Policy or any transaction contemplated hereby. You irrevocably and unconditionally waive any objection to the laying of venue of any action, suit or proceeding arising out of the Refund Policy or your use of the Services hereby in the Chosen Courts and hereby irrevocably and unconditionally waive and agrees not to plead or claim in any such court that any such action, suit or proceeding brought in such Chosen Courts has been brought in an inconvenient forum.
12. Severability
If any provision of this Refund Policy is found to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.
13. Policy Changes
ProjectX may change, update, and/or supplement this Refund Policy at any time with or without notice. Subscribers are solely responsible for staying current on this Refund Policy. Continued use of the API Add-On following any changes constitutes acceptance of any changes, update, or supplement.14.
